What is a Lasting Power of Attorney?
A Lasting Power of Attorney (LPA) is a legal document that allows you to appoint trusted people to make certain decisions on your behalf.
An unexpected illness or accident can leave someone unable to manage their affairs. Having an LPA in place helps ensure that the right people have the authority to act when needed.
There are two types of LPA in England and Wales:
Property & Financial Affairs – covering matters such as bank accounts, bills, pensions, investments, and buying or selling property. Once registered, it can also be used with your permission while you have capacity, subject to the terms you choose.
Health & Welfare – covering decisions about your care, medical treatment, and where you live. It can only be used when you cannot make the particular decision yourself. You can also expressly authorise your attorneys to make decisions about life-sustaining treatment.
Each serves a different purpose. Making both helps you plan for your financial and personal wellbeing.
Can my family make decisions without an LPA?
Being married, in a civil partnership, or someone’s next of kin does not automatically give a person authority to manage their finances or make decisions about their treatment.
Without suitable authority, your family may need to apply to the Court of Protection to manage your financial affairs. This can involve additional costs, delays, and ongoing responsibilities.
An LPA allows you to make these choices in advance, giving those closest to you a clearer basis for helping.
When should I make a Lasting Power of Attorney?
LPAs are relevant at every stage of adult life. If you have a home, financial commitments, or people who depend on you, it is worth considering how those responsibilities would be managed if you needed support.
You must have the mental capacity to make an LPA when you create it. It must also be registered with the Office of the Public Guardian before it can be used.
Planning early gives you time to consider your options and make informed decisions.
Do I need an LPA if I already have a Will?
A Will sets out what should happen to your estate after your death. An LPA deals with decisions during your lifetime.
Together, they form an important part of your estate planning, helping you prepare for different circumstances and giving your family greater clarity.
